REGULAMIN CHANGE STUDIO


I. General Provisions

  1. These Terms and Conditions, hereinafter referred to as the “Terms”, define the rights and obligations of persons using the services provided by Change Studio
    spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw at ul. Stawki 2A/51, 00-193 Warsaw, entered into the Register of Entrepreneurs
    maintained by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Reg ister under KRS number
    0000971703, NIP 5252907995, share capital PLN 5,000.00, hereinafter referred to as “CHANGE Studio”.
  2. CHANGE Studio means the locations operated by Change Studio sp. z o.o., currently located at Wronia 10 and Leszczyńska 1A in Warsaw.
  3. These Terms constitute an integral part of the membership agreement, hereinafter referred to as the “Agreement”, concluded between CHANGE Studio and
    the client, hereinafter referred to as the “Member”.
  4. Services offered by CHANGE Studio may be used exclusively by persons holding an active membership, valid one-time pass, voucher or another entitlement
    accepted by CHANGE Studio.
  5. The purchase of a membership, one-time pass, voucher or the use of CHANGE Studio services constitutes acceptance of these Terms.
  6. A Member of CHANGE Studio may be an adult with full legal capacity or a person over 16 years of age with written consent of a legal guardian granted in the
    presence of CHANGE Studio staff.
  7. CHANGE Studio reserves the right to refuse services to persons violating these Terms, accepted standards of social conduct or disturbing the comfort of other
    Members.
  8. The use of selected CHANGE Studio services may require an active account in the booking system or application used by CHANGE Studio.
  9. Before using CHANGE Studio services, the Member is obliged to read these Terms.
  10. CHANGE Studio reserves the right to periodically limit the number of available memberships, services or spots in selected classes.


II. Membership at CHANGE Studio

  1. A Member of CHANGE Studio may be an adult with full legal capacity or a person over 16 years of age with written consent of a legal guardian.
  2. For identification purposes, CHANGE Studio may require the Member to take an identification photo or send a current photo via e-mail to office@studiochange.pl.
  3. The membership agreement may be concluded for a fixed term of one month, one year or another period specified in the current CHANGE Studio offer.
  4. Membership is personal and may only be used by the person who concluded the Agreement with CHANGE Studio.
  5. Sharing, reselling, transferring or allowing third parties to use the membership is prohibited.
  6. CHANGE Studio may use various forms of Member identification, including in particular:
    A. mobile application,
    B. QR code,
    C. client account,
    D. membership card,
    E. identity document.
  7. Membership is activated after the payment has been successfully received or on a date agreed between CHANGE Studio and the Member.
  8. CHANGE Studio may refuse entry or temporarily block access to services in particular in the event of:
    A. outstanding payments,
    B. violation of the Terms,
    C. sharing membership with third parties,
    D. aggressive or inappropriate behaviour,
    E. disturbing the comfort of other Members,
    F. justified doubts regarding the Member’s identity,
    G. violation of booking rules or CHANGE Studio operating rules.
  9. CHANGE Studio reserves the right to temporarily disable selected services, zones or equipment in particular in the event of:
    A. breakdowns,
    B. servicing works,
    C. technical works,
    D. modernization,
    E. renovations,
    F. circumstances beyond the control of CHANGE Studio.
  10. Selected membership types may:
    A. apply only to a specific location,
    B. include a visit limit,
    C. include a group classes limit,
    D. include selected services only,
    E. have limited availability,
    F. include limited access to selected zones or service hours.
  11. CHANGE Studio does not guarantee availability of spots in specific classes, services, training sessions or with specific Instructors, even in the case of an active
    membership.
  12. The Member is obliged to independently monitor the number of available entries, classes and validity of services assigned to their membership, package or pass in
    the booking system or application used by CHANGE Studio.
  13. The Member is responsible for the correctness of reservations made, including in particular the selected location, class type , reservation date and reservation
    time.
  14. In the event that the service or class limit included in the membership has been exceeded, additional entries or reservations may be charged in accordance with
    the current CHANGE Studio Price List.
  15. Lack of knowledge regarding the use of available services or class limits does not constitute grounds for cancellation of charges for additional services or entries.
  16. CHANGE Studio may verify the use of memberships, entries and services based on data stored in the booking system, application or access systems used by
    CHANGE Studio.
  17. The Member is obliged to keep their contact details up to date, in particular their phone number and e-mail address.
  18. Membership suspension is possible only after prior notification to CHANGE Studio via e-mail or at the reception desk.
  19. Suspension may only be activated for an active and fully paid membership.
  20. Membership suspension results in a corresponding extension of the membership period, billing period and validity of services included in the membership,
    including Pilates packages and limited classes.
  21. During the suspension period, CHANGE Studio does not provide services resulting from the Agreement.
  22. Membership suspension is not possible during the notice period of the Agreement.
  23. CHANGE Studio may individually agree to suspend a membership for health-related reasons or other exceptional circumstances.
  24. Unused suspension days are non-refundable and cannot be transferred after the termination of the Agreement.
  25. CHANGE Studio may refuse to activate a suspension in the event of violation of the Terms or outstanding payments.
  26. CHANGE Studio reserves the right to limit the number of active group class bookings a Member may hold simultaneously. The current limit is determined by
    CHANGE Studio and published in the booking system or application.
  27. CHANGE Studio may temporarily or permanently limit access to selected services, benefits, zones or membership functionalities in the event of abuse of
    membership rules, booking systems, policies applicable at CHANGE Studio or actions detrimental to CHANGE Studio or other Members.
  28. Use of CHANGE Studio services without an active membership, valid entry pass, package or other active authorization to use the services may result in charges in
    accordance with the current CHANGE Studio Price List.
  29. Failure to complete check-in, failure by CHANGE Studio staff to verify membership status upon entry, or being allowed to enter the premises of CHANGE Studio
    does not constitute confirmation of an active authorization to use the services and does not release the Member from payment for services used.


III. Payments

  1. Fees for services provided by CHANGE Studio are charged in advance in accordance with the current Price List and the terms of the selected membership.
  2. The Member is obliged to pay all fees resulting from the Agreement on time throughout the entire term of the Agreement.
  3. Failure to use CHANGE Studio services does not release the Member from the obligation to pay fees resulting from the Agreement on time.
  4. Payments may be made in particular by:
    A. cash,
    B. payment card,
    C. bank transfer,
    D. electronic payment operators,
    E. recurring payments via PayU or other payment systems used by CHANGE Studio.
  5. In the case of recurring payments, the Member agrees to automatic collection of payments in accordance with the payment sched ule resulting from the
    Agreement.
  6. Any change of payment method requires prior notification to CHANGE Studio via e-mail or at the reception desk.
  7. Delay in payment may result in:
    A. temporary suspension of access to CHANGE Studio,
    B. suspension of the possibility to book classes,
    C. suspension of services,
    D. termination of the Agreement in accordance with the provisions of these Terms.
  8. CHANGE Studio reserves the right to pursue outstanding payments resulting from the Agreement, including transferring the matt er to debt collection or legal
    services.
  9. In the event of an unjustified payment reversal, chargeback claim or cancellation of payment by the Member, CHANGE Studio may temporarily block the
    membership until the matter is clarified.
  10. The intention to receive a VAT invoice with a tax identification number (NIP) must be reported no later than at the time of p ayment. After a fiscal receipt
    without a NIP number has been issued, issuing a VAT invoice with a NIP number afterwards may not be possible under applicable law.
  11. Fees for upfront memberships, packages and other prepaid services are non-refundable unless applicable law provides otherwise or CHANGE Studio decides
    otherwise individually.
  12. Failure to use services included in the membership, package or one-time pass does not constitute grounds for a refund.
  13. CHANGE Studio reserves the right to change the Price List, introduce temporary promotions and limited offers.
  14. Changes to the Price List do not affect the terms of active Agreements concluded before such changes enter into force, unless otherwise stated in the terms
    of a specific offer or required by applicable law.
  15. In the case of Agreements with a notice period, submitting a termination notice does not release the Member from the obligati on to pay all installments due
    until the end of the notice period.
  16. The notice period includes consecutive full billing periods resulting from the payment schedule assigned to the membership.


IV. Termination and Dissolution of the Agreement

  1. The Member may terminate a fixed-term Agreement with recurring payments:
    A. via e-mail sent to office@studiochange.pl,
    B. in writing at the CHANGE Studio reception desk.
  2. A termination notice may only be accepted provided that the Member has no outstanding payments towards CHANGE Studio.
  3. The notice period includes consecutive full billing periods resulting from the payment schedule assigned to the membership.
  4. Submission of a termination notice does not release the Member from the obligation to pay all installments due until the end of the notice period.
  5. Membership suspension is not possible during the notice period.
  6. CHANGE Studio may refuse to accept a termination notice until all outstanding payments towards CHANGE Studio have been settle d.
  7. The Agreement may be terminated at any time by mutual agreement of the parties.
  8. CHANGE Studio may temporarily suspend the provision of services instead of terminating the Agreement if the circumstances jus tify such a solution.
  9. CHANGE Studio may terminate the Agreement with immediate effect or refuse further provision of services in the event of:
    A. violation of these Terms,
    B. aggressive, vulgar or dangerous behaviour,
    C. disturbing the comfort of other Members,
    D. sharing membership with third parties,
    E. conducting unauthorized training sessions or commercial activities on the premises of CHANGE Studio,
    F. consumption of alcohol, narcotics or being under their influence,
    G. damaging CHANGE Studio property,
    H. violation of the privacy of other Members,
    I. creating commercial or advertising materials without the consent of CHANGE Studio,
    J. actions damaging the reputation, image or interests of CHANGE Studio,
    K. persistent violation of social conduct rules or CHANGE Studio operating rules,
    L. outstanding payments despite prior payment reminders.
  10. CHANGE Studio may refuse to conclude another Agreement or extend a membership without providing a reason.
  11. Changes to the class schedule, Instructor, operating hours of selected services, equipment, studio layout, availability of eq uipment or the scope of services
    provided do not constitute grounds for termination of the Agreement or claims against CHANGE Studio.
  12. In the event of temporary inability to provide services due to reasons beyond the control of CHANGE Studio, including in part icular:
    A. administrative decisions,
    B. technical failures,
    C. servicing works,
    D. renovations,
    E. restrictions concerning operation of the facility,
    F. force majeure,
    CHANGE Studio may temporarily limit the scope of services or suspend the operation of selected zones.
  13. In the event of complete closure of CHANGE Studio preventing the provision of services for a period longer than 30 days, the membership may be
    correspondingly extended or suspended for a period equivalent to the duration of the closure.
  14. A consumer who concluded the Agreement remotely may withdraw from the Agreement within 14 days in accordance with applicable law.
  15. Commencing the use of services before the expiry of the withdrawal period constitutes an explicit request by the Member for CHANGE Studio to begin
    providing services before the statutory withdrawal period expires. In the event of withdrawal from the Agreement after the commencement of services, the
    Member is obliged to cover the costs of services performed, activated or booked until the moment of withdrawal from the Agree ment.

V. Rules for Using CHANGE Studio Services

  1. CHANGE Studio services may only be used during the opening hours applicable at a given location and published on the website, in the application or at the
    CHANGE Studio reception desk.
  2. Entry to CHANGE Studio is permitted from the official opening time of the location, while the Member is obliged to leave CHANGE Studio no later than the closing
    time.
  3. Remaining on the premises of CHANGE Studio outside opening hours may be considered a violation of these Terms and may result in refusal of further services.
  4. On public holidays in Poland, CHANGE Studio may remain closed or operate on a limited basis. This does not constitute grounds for membership extension,
    refunds or compensation.
  5. Every Member is obliged to maintain personal culture, respect the comfort, privacy and relaxation atmosphere applicable at CH ANGE Studio.
  6. The following are prohibited on the premises of CHANGE Studio:
    A. loud behaviour,
    B. phone calls in training, wellness and chillout areas,
    C. video calls, online meetings or conversations on speakerphone,
    D. disrupting classes or training sessions,
    E. behaviour disturbing the use of services by other Members,
    F. playing music or audio materials without headphones,
    G. using private speakers or Bluetooth devices.
  7. If it is necessary to answer a phone call or conduct a conversation, the Member is obliged to leave the training area or class studio.
  8. The use of mobile phones during group classes is prohibited.
  9. CHANGE Studio may limit the use of the chillout zone or selected common areas for remote work, online meetings or activities not directly related to the use of
    CHANGE Studio services.
  10. Chillout zones and common areas of CHANGE Studio are not coworking spaces.
  11. Members are obliged to wear clean sportswear and clean sports footwear intended for exercise.
  12. Exercising without appropriate sportswear or barefoot is prohibited, except for classes where the nature of the activity requ ires it.
  13. The use of training, wellness and SPA areas in outerwear, wet footwear or clothing negatively affecting the comfort of other Members or hygiene standards is
    prohibited.
  14. Every Member is obliged to maintain personal hygiene and use a towel while exercising.
  15. During one visit, the Member may use a maximum of:
    A. one large towel,
    B. one small training towel.
  16. Abuse of the towel system or using towels contrary to their intended purpose may result in limitation of access to this servi ce, additional charges or termination of
    the Agreement.
  17. Reserving spots, equipment, loungers, mats or common spaces by leaving towels, bags, shakers or other personal belongings una ttended is prohibited.
  18. CHANGE Studio staff has the right to move unattended items if they obstruct the use of common areas or services by other Memb ers.
  19. Consuming meals in training areas is prohibited.
  20. The fitbar and gastronomic areas of CHANGE Studio are paid zones. Consuming personal food and beverages in these areas, especially products brought from
    outside CHANGE Studio, is prohibited.
  21. Taking beverages, tea, dishes or other products between CHANGE Studio zones, in particular from the chillout zone to the fitb ar and vice versa, is prohibited.
  22. Leaving food, shakers, bottles or other food products in common areas, refrigerators or lockers after the visit is prohibited .
  23. The following are strictly prohibited on the premises of CHANGE Studio:
    A. smoking tobacco products,
    B. using electronic cigarettes,
    C. consuming alcohol,
    D. using narcotics or psychoactive substances,
    E. remaining under the influence of alcohol or narcotics.
  24. Conducting commercial activity on the premises of CHANGE Studio without prior consent of CHANGE Studio is prohibited, in part icular:
    A. personal training sessions,
    B. sale of products or services,
    C. advertising recordings,
    D. marketing activities,
    E. influencer or sponsorship activities.
  25. Creating professional, commercial, sponsored or advertising photo and video materials on the premises of CHANGE Studio requires prior consent of CHANGE
    Studio.
  26. CHANGE Studio has the right to demand removal of materials created without the required consent and may refuse further servic es to persons violating the above
    rules.
  27. Recording, photographing or publishing the image of other Members or CHANGE Studio staff without their explicit consent is prohibited.
  28. Members are obliged to follow organizational instructions issued by CHANGE Studio staff.
  29. CHANGE Studio staff has the right to give warnings, refuse services, ask a person to leave a selected zone or remove from the premises persons violating the
    Terms, disturbing the comfort of others, or behaving aggressively, abusively or inappropriately towards staff or other Members.
  30. CHANGE Studio is not responsible for the lack of available parking spaces.
  31. Selected CHANGE Studio locations may offer parking validation for Members using CHANGE Studio services.
  32. Parking validation is available exclusively for Members and clients currently using CHANGE Studio services at the time of the ir visit.
  33. CHANGE Studio is not responsible for parking systems operated by external operators.
  34. Common areas of CHANGE Studio are not intended for storing bicycles, scooters, suitcases or other large private items. CHANGE Studio staff may refuse
    permission to leave such items on the premises.
  35. CHANGE Studio does not provide:
    A. storage services for private parcels, packages or deliveries of Members,
    B. printing, copying or scanning of private documents,
    C. charging of private electronic devices belonging to Members or clients.
  36. CHANGE Studio staff may refuse requests unrelated directly to the operation of services provided by CHANGE Studio.
  37. Animals are prohibited on the premises of CHANGE Studio.

VI. Gym Area and Group Classes at CHANGE Studio

  1. Training areas and group classes may only be used during the operating hours of a given location and in accordance with the c urrent class schedule published by
    CHANGE Studio.
  2. CHANGE Studio does not guarantee availability of spots in selected group classes, even in the case of an active membership.
  3. The number of spots in group classes, in particular Pilates Reformer classes, is limited.
  4. Class reservations may only be made through the booking system provided by CHANGE Studio.
  5. The Member is obliged to complete check-in before using services or participating in classes.
  6. CHANGE Studio may limit the number of active reservations that a Member may hold simultaneously.
  7. The Member is responsible for the correctness of their reservation, including in particular the selected location, class type and reservation time.
  8. The Member may cancel a group class reservation no later than 12 hours before the scheduled class start time.
  9. In the event of cancellation later than 12 hours before the class or absence from the class, the entry shall be considered us ed.
  10. Failure to receive a push notification, SMS, e-mail or reminder regarding classes does not release the Member from the obligation to independently monitor their
    reservations.
  11. Three absences from group classes or three late cancellations within a period of 3 weeks result in an automatic suspension of the ability to make group class
    reservations for the following 14 days.
  12. CHANGE Studio reserves the right to individually remove the suspension or apply other restrictions in justified cases.
  13. A Member placed on the waiting list may be automatically moved to the main participant list, including shortly before the sta rt of the class.
  14. Placement on the waiting list does not guarantee a spot in the class.
  15. The Member is obliged to independently monitor the status of their reservation and waiting list in the booking system or application.
  16. In justified situations, CHANGE Studio may cancel a reservation or remove a Member from a class without loss of entry or cons equences for the Member.
  17. The Member is obliged to arrive on time for group classes.
  18. Arriving more than 5 minutes after the start of a class may result in refusal of entry to the studio by the Instructor or CHA NGE Studio staff.
  19. The Instructor or CHANGE Studio staff may refuse entry to a class after it has started, regardless of the Member’s membership status or active reservation.
  20. Refusal of entry due to lateness may be treated as a used entry.
  21. The Instructor conducting the class has the right to refuse participation to a person whose health condition, behaviour, leve l of preparation or lateness may affect
    the safety or comfort of other participants.
  22. The Member is obliged to properly prepare for classes, including having the appropriate clothing, footwear or accessories req uired for a given class type.
  23. CHANGE Studio may require the use of grip socks during selected classes, in particular Pilates Reformer classes.
  24. A Member participating in classes for the first time is obliged to inform the Instructor before the start of the class.
  25. The Member is obliged to inform the Instructor about:
    A. pregnancy,
    B. injuries,
    C. medical conditions,
    D. feeling unwell,
    E. health issues that may affect the safety of performing exercises.
  26. Training equipment may only be used in accordance with its intended purpose and the instructions of CHANGE Studio staff.
  27. During group classes, personal training sessions or other services organized by CHANGE Studio, priority in the use of equipme nt, training studios and designated
    zones is given to persons participating in such classes or services.
  28. CHANGE Studio staff may temporarily restrict access to selected zones, equipment or devices for the purposes of classes, trai ning sessions or events.
  29. After finishing exercises, the Member is obliged to:
    A. return equipment to its designated place,
    B. leave the training area clean and organized,
    C. disinfect used equipment if required under the rules applicable at CHANGE Studio.
  30. Taking training equipment outside designated training areas or moving equipment between CHANGE Studio zones without staff consent is prohibited.
  31. Independently changing the settings of air conditioning, sound systems, lighting or other technical systems located on the premises of CHANGE Studio is
    prohibited.
  32. CHANGE Studio may change:
    A. the class schedule,
    B. the Instructor,
    C. the type of class,
    D. operating hours of selected services,
    E. availability of zones,
    in particular for organizational, technical or health-related reasons.
  33. Group classes may be cancelled in particular in the event of:
    A. Instructor unavailability,
    B. insufficient number of participants,
    C. technical failures,
    D. organizational reasons,
    E. force majeure.
  34. CHANGE Studio is not responsible for the inability to book a specific class or Instructor.
  35. Training in the gym area is performed at the Member’s own responsibility and in accordance with their current health condition and physical fitness level.

VII. Personal Training Services

  1. CHANGE Studio offers the possibility to use Personal Training and Personal Pilates services conducted by trainers and instructors cooperating with CHANGE
    Studio.
  2. Training sessions may take place in the following formats:
    A. SOLO,
    B. DUO,
    C. TRIPLE,
    D. or another training format currently available.
  3. The number of participants depends on the selected service type and the availability of rooms and equipment.
  4. Personal Training services may only be used after prior reservation of a training session.
  5. A training reservation is considered confirmed after acceptance by CHANGE Studio, the Trainer or the Instructor.
  6. As a standard rule, Personal Training services are settled through CHANGE Studio unless CHANGE Studio decides otherwise.
  7. The use of Personal Training services may require an active membership or valid entry pass in accordance with the current CHA NGE Studio offer.
  8. Payment for training sessions or training packages is made in advance in accordance with the current Price List.
  9. Training packages have a specific validity period indicated at the time of purchase or resulting from the current CHANGE Stud io offer.
  10. Unused training sessions or training packages expire after the validity period and are non-refundable.
  11. A Personal Training session may be cancelled or rescheduled without consequences no later than 24 hours before the scheduled start time.
  12. In the event of cancellation later than 24 hours before the training session, absence or lateness preventing the session from taking place, the training session
    shall be considered completed.
  13. Members are obliged to arrive on time for training sessions.
  14. The training session ends at the scheduled time regardless of the Member’s lateness.
  15. The Trainer or Instructor has the right to refuse to conduct or allow participation in a training session, especially in the event of:
    A. poor health condition of the Member,
    B. health contraindications,
    C. lateness,
    D. aggressive or inappropriate behaviour,
    E. being under the influence of alcohol or narcotics,
    F. violation of the CHANGE Studio Terms.
  16. The Member is obliged to inform the Trainer or Instructor about:
    A. injuries,
    B. physical conditions,
    C. pregnancy,
    D. health contraindications,
    E. any circumstances that may affect the safety of the training session.
  17. CHANGE Studio does not guarantee the availability of a specific Trainer, Instructor or specific training hour.
  18. CHANGE Studio reserves the right to change the Trainer, Instructor, training room or training hour for organizational, techni cal or health-related reasons.
  19. Changing the Trainer, Instructor or training location does not constitute grounds for a refund or termination of the Agreemen t.
  20. CHANGE Studio may cancel or reschedule a training session particularly in the event of:
    A. Trainer unavailability,
    B. technical failures,
    C. organizational issues,
    D. room unavailability,
    E. force majeure.
  21. Conducting private training sessions, providing training services or organizing paid training sessions on the premises of CHA NGE Studio without prior consent
    of CHANGE Studio is prohibited.
  22. Creating professional, sponsored or commercial photo and video materials during personal training sessions requires prior con sent of CHANGE Studio.
  23. Personal Training sessions take place at the Member’s own risk and in accordance with their current health condition and phys ical fitness level.


VIII. SPA, Wellness, Sauna and Cold Plunge Area

  1. CHANGE Studio offers SPA, wellness, massage, sauna, cold plunge and other recovery services available in the current CHANGE S tudio offer.
  2. SPA and wellness services may only be used upon prior reservation or in accordance with the rules applicable in a given area.
  3. SPA service reservations are considered confirmed once accepted by CHANGE Studio.
  4. The Member is obliged to arrive on time for the reserved service.
  5. Late arrival may result in shortening of the service duration without the right to a price reduction or refund.
  6. In the event of arriving more than 15 minutes late, CHANGE Studio may refuse to provide the service and consider it completed .
  7. Cancellation or rescheduling of SPA services is possible no later than 24 hours before the scheduled service start time.
  8. In the event of cancellation later than 24 hours before the service or absence, the service shall be considered completed.
  9. The use of SPA, wellness, sauna and cold plunge services is at the Member’s own responsibility.
  10. The Member is obliged to inform CHANGE Studio staff about any health contraindications that may affect the safety of using the services.
  11. CHANGE Studio recommends prior medical consultation in the case of:
    A. cardiovascular diseases,
    B. hypertension,
    C. pregnancy,
    D. neurological conditions,
    E. skin diseases,
    F. inflammatory conditions,
    G. injuries,
    H. other medical conditions that may constitute contraindications for wellness services.
  12. The use of SPA, wellness, sauna and cold plunge services under the influence of alcohol, narcotics or psychoactive substances is prohibited.
  13. CHANGE Studio staff may refuse to provide services or access to the wellness area to persons whose health condition or behavi our may pose a risk to themselves
    or others.
  14. Before using the sauna, cold plunge or selected wellness areas, the Member is obliged to take a shower.
  15. The Member is obliged to maintain a high standard of personal hygiene while using wellness, SPA and sauna areas.
  16. The sauna and wellness area are designated quiet and relaxation zones.
  17. The following are prohibited in sauna and wellness areas:
    A. loud conversations,
    B. use of mobile phones,
    C. video calls or speakerphone conversations,
    D. playing music or audio materials without headphones,
    E. behaviour disturbing the comfort of other persons.
  18. CHANGE Studio may issue warnings, refuse further use of the wellness area or remove persons disturbing the atmosphere of sile nce, relaxation or the comfort of
    other Members.
  19. The use of the sauna is permitted only with a towel protecting the bench surface from direct body contact.
  20. Pouring essential oils directly onto sauna stones without first diluting them in an appropriate amount of water is prohibited .
  21. CHANGE Studio may refuse access to the sauna to persons violating hygiene or safety rules.
  22. The use of cold plunge tubs, ice baths and other wellness or recovery devices should be carried out in accordance with the instructions of CHANGE Studio staff
    and safety rules applicable at CHANGE Studio.
  23. Independently changing settings of wellness, recovery, sauna, cold plunge or other technical devices located in SPA and wellness areas is prohibited.
  24. CHANGE Studio is not responsible for health consequences resulting from the use of services despite existing medical contraindications.
  25. CHANGE Studio may temporarily exclude selected SPA or wellness areas from use for technical, servicing, organizational or safety reasons.
  26. Changes in therapist, massage therapist or availability of selected wellness services do not constitute grounds for refunds or claims against CHANGE Studio.

IX. Health Conditions and Member Responsibility

  1. The use of CHANGE Studio services takes place at the Member’s own risk and in accordance with their current health condition and physical abilities.
  2. The Member declares that their health condition allows them to use the services offered by CHANGE Studio, including in partic ular:
    A. gym facilities,
    B. group classes,
    C. personal training sessions,
    D. SPA and wellness services,
    E. sauna,
    F. cold plunge,
    G. other services available in the CHANGE Studio offer.
  3. In the event of any doubts regarding health condition or the ability to perform physical exercise, CHANGE Studio recommends p rior medical consultation.
  4. The Member is obliged to inform CHANGE Studio staff, the Instructor, Trainer or therapist about:
    A. pregnancy,
    B. injuries,
    C. physical conditions,
    D. chronic illnesses,
    E. health contraindications,
    F. feeling unwell,
    G. any circumstances that may affect the safe use of services.
  5. The use of CHANGE Studio services despite existing health contraindications that may pose a threat to the health or life of t he Member or other persons is
    prohibited.
  6. CHANGE Studio, the Instructor, Trainer or therapist have the right to refuse participation in classes, training sessions or services to a person whose health
    condition or behaviour may affect the safety of themselves or others.
  7. CHANGE Studio shall not be liable for health consequences resulting from:
    A. withholding information about health condition,
    B. using services despite health contraindications,
    C. failure to follow instructions of CHANGE Studio staff,
    D. using equipment or services contrary to their intended purpose.
  8. The Member is obliged to use equipment and devices available at CHANGE Studio in accordance with their intended purpose and instructions provided by
    staff.
  9. CHANGE Studio shall not be liable for injuries, accidents or deterioration of health resulting from improper performance of exercises or use of services
    contrary to staff recommendations.
  10. The Instructor, Trainer, therapist or CHANGE Studio staff have the right to interrupt training, classes or services in the event of justified suspicion of a threat to
    the health or safety of the Member or other persons.
  11. In emergency situations, CHANGE Studio has the right to call medical assistance or take actions necessary to protect the heal th and life of the Member.
  12. CHANGE Studio does not guarantee achieving specific training, sports, health or aesthetic results resulting from the use of CHANGE Studio services.
  13. Minors may use CHANGE Studio services only with the consent and under the responsibility of their legal guardian.

X. Member Property

  1. During their stay at CHANGE Studio, the Member may use lockers located in the changing rooms.
  2. Lockers provided by CHANGE Studio are intended exclusively for temporary storage of belongings during the current visit to CH ANGE Studio.
  3. Lockers do not constitute a deposit service within the meaning of applicable law.
  4. The Member is obliged to empty the locker and collect all personal belongings before leaving CHANGE Studio.
  5. CHANGE Studio has the right to open a locker particularly in the event of:
    A. leaving it locked after CHANGE Studio operating hours,
    B. suspicion of a security threat,
    C. technical failure,
    D. justified organizational or sanitary necessity.
  6. CHANGE Studio is not responsible for:
    A. items left on the premises of CHANGE Studio,
    B. items left in lockers,
    C. items left in changing rooms, bathrooms, SPA areas, sauna, chillout zones, fitbar or other areas of CHANGE Studio,
    D. loss, damage or theft of the Member’s belongings.
  7. CHANGE Studio recommends not leaving valuable items on the premises, especially:
    A. cash,
    B. jewellery,
    C. documents,
    D. laptops,
    E. tablets,
    F. cameras,
    G. watches,
    H. other valuable items.
  8. Charging phones, computers and other electronic devices on the premises of CHANGE Studio is done solely at the Member’s own r isk.
  9. It is prohibited to leave in lockers or on the premises of CHANGE Studio:
    A. dangerous items,
    B. flammable substances,
    C. narcotics,
    D. food products that may spoil,
    E. items that may pose sanitary or safety risks.
  10. Items found on the premises of CHANGE Studio are stored under the Lost & Found procedure for a maximum period of 14 days.
  11. After the period indicated in section 10, unclaimed items may be disposed of, sent for disposal or donated to charity.
  12. CHANGE Studio is not responsible for items left in parking areas located near CHANGE Studio facilities or for damage to or th eft of vehicles.
  13. Video surveillance may operate on the premises of CHANGE Studio for the purpose of:
    A. ensuring safety,
    B. protection of property,
    C. access control,
    D. limiting behaviour violating these Terms.
  14. Surveillance does not include areas where it could violate the privacy of persons using CHANGE Studio, particularly toilets and changing rooms.
  15. The Member bears financial responsibility for damage caused through their fault on the premises of CHANGE Studio, particularly for damage to equipment,
    furnishings or infrastructure elements of the facility.

XI. Complaint Procedure

  1. Members have the right to submit complaints regarding services provided by CHANGE Studio.
  2. Complaints may be submitted:
    A. via e-mail to office@studiochange.pl,
    B. in writing at the CHANGE Studio reception desk.
  3. A complaint submission should include:
    A. the Member’s full name,
    B. contact details,
    C. a description of the situation forming the basis of the complaint,
    D. the Member’s request.
  4. CHANGE Studio may ask the Member to provide additional information necessary to process the complaint.
  5. Complaints are reviewed within 14 business days from the date of receiving a complete submission.
  6. CHANGE Studio informs the Member about the complaint decision via e-mail or phone.
  7. Filing a complaint does not entitle the Member to:
    A. independently suspend payments,
    B. reverse payments,
    C. refuse to fulfill obligations resulting from the Agreement.
  8. CHANGE Studio reserves the right to individually determine the method of resolving complaints, including offering:
    A. an additional entry,
    B. extension of service validity,
    C. rescheduling of a service,
    D. another form of compensation considered appropriate by CHANGE Studio.
  9. Complaints shall not constitute grounds for claims, in particular in the event of:
    A. temporary lack of availability in group classes,
    B. limited availability of selected services,
    C. changes of Instructor, Trainer, therapist or schedule,
    D. cancellation of classes or services due to organizational or technical reasons,
    E. temporary technical issues related to booking systems or applications,
    F. temporary exclusion of selected zones or equipment from use,
    G. Member lateness,
    H. subjective opinions regarding the nature of classes or services,
    I. lack of available parking spaces,
    J. restrictions resulting from rules applicable in the building or by external operators.
  10. Failure to receive a push notification, SMS or e-mail regarding reservations, waiting lists, class cancellations, payments or reminders does not release the Member
    from the obligation to independently monitor their account, reservations and service status in the booking system or application.
  11. CHANGE Studio does not guarantee uninterrupted and completely error-free operation of booking systems, mobile applications, payment systems or services
    provided by external technology providers.
  12. CHANGE Studio is not responsible for limitations or technical issues resulting from the operation of external IT systems, pay ment operators, mobile applications,
    technology providers or telecommunication operators.
  13. Complaints regarding payments, settlements, system errors or membership-related irregularities should be reported immediately after noticing the issue.
  14. Complaints regarding the Member’s health condition or well-being are reviewed solely within the scope resulting from applicable law and the provisions of these
    Terms.
  15. CHANGE Studio reserves the right to reject complaints where the issue results from:
    A. violation of the Terms by the Member,
    B. use of services contrary to staff recommendations,
    C. concealment of medical contraindications,
    D. actions or omissions of the Member.
  16. CHANGE Studio may refuse to accept complaints or grant additional benefits in the event of repeated submissions lacking reasonable grounds or abuse of
    individual exceptions and goodwill actions applied by CHANGE Studio.

XII. Changes to the Terms and Conditions

  1. CHANGE Studio reserves the right to amend these Terms for important reasons, in particular in the event of:
    A. changes in applicable law,
    B. changes to the company details or business structure of CHANGE Studio,
    C. organizational or technical changes,
    D. introduction of new services or functionalities,
    E. changes to booking, payment or access systems,
    F. the need to improve safety or service quality,
    G. changes to the Offer or Price List,
    H. the need to adapt the Terms to administrative decisions or court rulings.
  2. The current version of the Terms is available:
    A. on the CHANGE Studio website,
    B. at the CHANGE Studio reception desk,
    C. in systems or applications used by CHANGE Studio.
  3. CHANGE Studio shall inform Members about changes to the Terms via e-mail, application notification or publication on the website.
  4. Changes to the Terms enter into force 14 days after their publication or after informing Members, unless:
    A. applicable law requires a shorter period,
    B. the change is related to safety,
    C. the change is technical or organizational and requires faster implementation.
  5. Continued use of CHANGE Studio services after the changes enter into force constitutes acceptance of the updated Terms.
  6. If the Member does not accept the changes to the Terms, the Member has the right to terminate the Agreement in accordance wit h the rules specified in
    these Terms.
  7. Changes to the Terms or the Price List do not affect the conditions of active Agreements concluded before such changes entered into force, unless otherwise
    required by applicable law, the terms of a specific offer or the provisions of the Agreement.

XIII. Personal Data Processing Rules

  1. The controller of Members’ personal data is CHANGE Studio sp. z o.o. with its registered office in Warsaw.
  2. Members’ personal data is processed in particular for the purpose of:
    A. concluding and performing the Agreement,
    B. handling memberships and reservations,
    C. processing payments,
    D. contacting the Member,
    E. ensuring safety on the premises of CHANGE Studio,
    F. fulfilling obligations resulting from applicable law,
    G. pursuing or defending claims,
    H. conducting organizational and administrative activities related to the operation of CHANGE Studio.
  3. Personal data may be transferred to entities cooperating with CHANGE Studio to the extent necessary for the provision of services, in particular:
    A. payment operators,
    B. booking system providers,
    C. IT service providers,
    D. hosting and e-mail service providers,
    E. accounting and legal service providers,
    F. entities supporting the administrative and technical operation of CHANGE Studio.
  4. CHANGE Studio may contact the Member via:
    A. e-mail,
    B. telephone,
    C. SMS,
    D. applications or systems used by CHANGE Studio,
    in matters related to the provision of services, class organization, payments or the operation of CHANGE Studio.
  5. Video surveillance may operate on the premises of CHANGE Studio for the purpose of:
    A. ensuring safety,
    B. protection of property,
    C. access control,
    D. limiting behaviour violating these Terms.
  6. Surveillance does not include areas where it could violate the privacy of persons using CHANGE Studio, particularly toilets and changing rooms.
  7. Participation in events organized by CHANGE Studio may involve recording the Member’s image in the form of photographs or video materials used by
    CHANGE Studio for informational, promotional or marketing purposes.
  8. Personal data is stored for the duration of the Agreement and for the period required by applicable law or necessary to secur e potential claims.
  9. The Member has the right to:
    A. access their personal data,
    B. rectify personal data,
    C. erase personal data,
    D. restrict processing,
    E. object to processing,
    F. data portability,
    G. lodge a complaint with the President of the Personal Data Protection Office.
  10. Providing personal data is voluntary; however, failure to provide such data may make it impossible to use CHANGE Studio servi ces.
  11. In matters related to personal data protection, contact is possible via: office@studiochange.pl.
